Experts believe Lohan may get 180 days in jail. Going back to rehab would be her best bet to avoid jail time. LOS ANGELES - Lindsay Lohan’s best bet for avoiding jail time is to go back into rehab yet again and remove herself from a high-flying party lifestyle — if not, she could be facing up to six months behind bars, legal observers said Wednesday.
Lohan, 21, was less than two weeks out of a recovery program and was voluntarily wearing an alcohol-monitoring device when she was arrested Tuesday in Santa Monica for investigation of misdemeanor driving both under the influence and with a suspended license, and felony cocaine possession.
Her lawyer, Blair Berk, has said she had a “relapse” and was receiving medical care at an undisclosed location. A call to Lohan’s publicist was not returned Wednesday.
The actress completed more than six weeks in rehab less than two weeks ago, and had checked into another recovery clinic in January.
Over the weekend, she was photographed at a party in a pink bikini, with the monitoring device on her ankle.
That behavior won’t cut it anymore and neither will spa-style clinics, said Barry Gerald Sands, a Century City defense attorney who’s also a certified drug and alcohol counselor.
“Whatever you have done in the past, do a 360-degree turn and go the other way,” Sands said Wednesday. “She has to change her alleged friends, people sharing or selling her drugs. She has to lead a clean and sober life.
“Silk-sheet recovery homes don’t do the job.”
Rehab rather than jail
If Lohan is charged with a crime, she could ask a judge to order her to remain in rehabilitation while she awaits trial, Sands said.
A “recovery team” should be in place that includes doctors and addiction specialists who can give the judge alternatives to jail. And if she is convicted, the rehab time would count against whatever jail sentence is issued, Sands said.
Lohan has never been convicted of a drug or alcohol crime and judges routinely place first-time DUI offenders on probation rather than behind bars. However, Lohan’s case could be complicated because she also was arrested for investigation of felony DUI in Beverly Hills on Memorial Day after her Mercedes-Benz crashed into a curb.
That case was submitted to the Los Angeles County district attorney’s office last week and is being reviewed, spokeswoman Jane Robison said.
If she is convicted of two felonies in the two cases, she might be eligible for 18 months or more in state prison but such a sentence is unlikely, said Lawrence Taylor, a former Los Angeles prosecutor who runs one of the nation’s top DUI defense law firms.
“Our prisons are packed already,” he said. “We don’t need some recreational (drug) users with a small amount of coke with a clean record.”
Paris case puts pressure on prosecutors, judges
On the other hand, Lohan probably will have to do some time in county jail simply because prosecutors and judges saw the backlash when Paris Hilton was briefly allowed to serve her DUI sentence at home instead of jail.
“They’re going to see how sensitive everything was ... Everything was being looked at with a microscope and broadcast to the entire world, literally,” Taylor said. “They saw what happened and judges do run for re-election, and deputy DAs are aware that their bosses run for re-election.” Both sides would be interested in stalling a court case until the media frenzy ebbs but that is unlikely if the continued scrutiny of Paris Hilton is any signpost, Taylor said.
“Entertainment has become more important than information and the media is looking ... for money. They’re looking for audience, they’re looking to give the public what they want,” he said.
That scrutiny means that Lohan, if convicted, probably will get some jail time regardless of whether it is warranted in her case, Taylor said.
“I would say this woman’s going to be doing at least 30 days” and perhaps as long as 180 days if she is convicted of two DUIs along with drug possession, Taylor said.
However, virtually all DUI cases are settled by plea agreements.

LOS ANGELES - After only three days behind bars, Paris Hilton traded a 12-by-8-foot cell for her 2,700-square-foot Hollywood Hills home when she was released early Thursday because of an unspecified medical condition.
Hilton was to be under home confinement, wearing an electronic monitoring ankle bracelet, for the remaining 40 days of her sentence for violating probation in a reckless driving case.
The celebrity inmate was sent home from the L.A. County jail’s Lynwood lockup shortly after 2 a.m. in a stunning reduction to her original 45-day sentence.
No details were available on the nature of Hilton’s medical condition. Sheriff’s spokesman Steve Whitmore refused to answer questions about whether it was physical or psychological. Hilton’s lawyer and publicist did not return calls seeking comment.
“I can’t specifically talk about the medical situation other than to say that yes, it played a part in this,” Whitmore said at an early morning news conference outside the jail.
The decision to release Hilton was made by Sheriff Lee Baca, according to the Probation Department. A deputy at the sheriff’s information bureau said there would be no comment.
Hilton’s sentence was first cut from 45 to 23 days because of “good behavior.” When she chose to serve her time under house arrest, the sentence reverted to the original 45 days. Although she spent only three days in jail, she was credited for five because she checked in late Sunday and left early Thursday, leaving her with 40 days.
On Sunday night, after a surprise red-carpet appearance at the MTV Movie Awards, Hilton surrendered to authorities with little fanfare.
“I am trying to be strong right now,” she told reporters at the time. “I’m ready to face my sentence. Even though this is a really hard time, I have my family, my friends and my fans to support me, and that’s really helpful.”

Paris Hilton Checks Into L.A. Jail

LOS ANGELES (AP) — Hours after strolling the red carpet in a strapless black dress, Paris Hilton traded her designer duds for a jail-issued jumpsuit.
The 26-year-old heiress checked into the Century Regional Detention Facility in Lynwood just after 11:30 p.m. Sunday. She's expected to serve three-weeks for violating her probation in an alcohol-related reckless driving case.
Hilton surrendered to sheriff's deputies after making a surprise visit to the MTV Movie Awards in the afternoon.
"I am trying to be strong right now," she told reporters on the red carpet. "I'm ready to face my sentence. Even though this is a really hard time, I have my family, my friends and my fans to support me, and that's really helpful."
Sheriff's spokesman Steve Whitmore said Hilton was easy to work with.
"Her demeanor was helpful. She was focused, she was cooperative," he said.
Hilton turned herself in at the Men's Central Jail in downtown Los Angeles just after 10:30 p.m., then was escorted to the all women's facility in Lynwood, where she was booked, fingerprinted and issued a jail uniform, Whitmore said.
She also was given her first meal: cereal, bread and juice.
So far, Hilton does not have a cellmate, Whitmore said.
The "Simple Life" star will be housed in the "special needs" unit of the 13-year-old jail, separate from most of its 2,200 inmates. The unit contains 12 two-person cells reserved for police officers, public officials, celebrities and other high-profile inmates.
Like other inmates in that unit, Hilton will take her meals in her cell and will be allowed outside the 12-foot-by-8-foot space for at least an hour each day to shower, watch TV in the day room, participate in outdoor recreation or talk on the telephone. No cell phones or BlackBerrys are permitted in the facility, even for visitors.
The jail, a two-story concrete building next to train tracks and beneath a bustling freeway, has been an all-female facility since March 2006. It's located in an industrial area about five miles southeast of downtown Los Angeles.
"I did have a choice to go to a pay jail," Hilton said Sunday, without giving details. "But I declined because I feel like the media portrays me in a way that I'm not and that's why I wanted to go to county, to show that I can do it and I'm going to be treated like everyone else. I'm going to do the time, I'm going to do it the right way."
When she was sentenced May 4, Superior Court Judge Michael T. Sauer ruled that she would not be allowed any work release, furloughs or use of an alternative jail or electronic monitoring in lieu of jail.
Sometimes stars are allowed to do their time in a jail of their choosing. In such cases they pay a daily room-and-board fee to the smaller jails, which afford them more privacy and comfort.
Cop-slapping actress Zsa Zsa Gabor, for example, served three days behind bars in 1990 at the El Segundo jail near the Los Angeles International Airport. She paid $85 a day.
On Saturday, about 15 photographers, reporters and television crews staked out the entrances to the jail waiting for the celebutante's arrival. Authorities had also cordoned off a grassy area outside the facility for the media. She had until Tuesday to report.
On Sunday, about a dozen photographers and television crews were at the Lynwood facility when she arrived in an unmarked SUV. Video captured by celebrity news site TMZ.com showed Hilton inside the vehicle with her mother, Kathy.
Hilton's publicist, Elliot Mintz, said he spoke with Kathy Hilton after she returned from the jail.
"She told me it was very emotional," Mintz said. "She also said that she feels this will be a time when Paris will be able to think and reflect and to spend time alone to learn from the experience because in Paris' life she's never alone — there's always a constant chatter around her."
Officers arrested Hilton in Hollywood on Sept. 7. In January, she pleaded no contest to the reckless-driving charge and was sentenced to 36 months' probation, alcohol education and $1,500 in fines.
She was pulled over by California Highway Patrol on Jan. 15. Officers informed Hilton she was driving on a suspended license and she signed a document acknowledging she was not to drive. She then was pulled over by sheriff's deputies on Feb. 27, at which time she was charged with violating her probation.

Jordin Sparks Crowned 'American Idol'

AP) The big voice overwhelmed the beatbox Wednesday night as Jordin Sparks was crowned the newest and youngest "American Idol."
Sparks, 17, of Glendale, Ariz., prevailed over Blake Lewis, 25, of Bothell, Wash., after a triumphant performance Tuesday that wowed the show's judges and the viewers who gave her a majority of the record 74 million votes cast.
"Mom, Dad, I love you," Sparks, the daughter of retired NFL player Phillippi Sparks, said tearfully after a bearhug from Lewis.
In an interview backstage with The Associated Press, the overwhelmed winner recalled talking with her dad about how she used to watch him sign autographs.
Sparks said he told her, "`You're more famous than me now.' And I was like, `Oh, Dad, that's so weird.'"
Did she feel she grew as an artist during the competition, as the series' judges remarked?
"I totally think I did," Sparks said. "I've just been trying to top myself each week ... I would sing my song and then after I was done I was, `OK, what am I going to do next week that's going to be ... just as good or better."
The contest came down to either the stronger singer, Sparks, or the better entertainer, Lewis. Sparks delivered her songs simply and powerfully; Lewis' flourishes included his beatbox sound effects and sharp dance moves.
Even the famous were gushing over Sparks.
"She is an awesome singer," finale performer Smokey Robinson said backstage. "She sings so good, it's hard to believe she's 17. To sing like that you would have to have lived for a long time. She's an old soul."
The finale pulled out the stops and the stars, with Gwen Stefani, Tony Bennett, Bette Midler, Green Day and more singing.
The two-hour show opened with Lewis and Sparks dueting on the Beatles "I Saw Her Standing There," followed quickly by a touring Stefani singing "4 in the Morning" via satellite from Massachusetts.
Midler took the stage as the show came toward its close, singing "The Wind Beneath My Wings."
Past "Idol" winners and this season's contestants got a hefty share of attention, starting with first-season winner Kelly Clarkson. She performed her new single "Never Again," with the gritty rock song matched by her black dress and thigh-high boots.
Carrie Underwood, the fourth-season idol, sang "I'll Stand by You" and was honored by legendary music mogul Clive Davis for reaching 6 million in sales for her debut album, "Some Hearts."
Taylor Hicks, last season's winner, also had his moment in the finale sun, as did Ruben Studdard, the winner from year two.
Robinson, a Motown great, performed "Being with You" after the top six male contestants, including fan fave Sanjaya Malakar, sang "Ooh Baby Baby," a hit for Robinson and his group the Miracles.
Blake, whose beat-boxing scored with viewers, performed with veteran rapper Doug E. Fresh on his old hit, "The Show." It was a signature moment for a contest that has introduced young viewers to Gershwin and other standards.
"True originals," host Ryan Seacrest said of the duo.
Gladys Knight took the stage with the six female finalists, belting out "I Feel a Song" and "Midnight Train to Georgia." Bennett performed a mellow version of "For Once in My Life" that ended with a big finish.
"A true idol, Tony Bennett, ladies and gentlemen," Seacrest gushed, with good reason.
Melinda Doolittle, arguably the best "Idol" contestant to miss out on the finale, returned to impress the crowd again as she sang "Hold Up the Line" with gospel stars BeBe and CeCe Winans.
"She has proven in the last few months to be spectacular," BeBe Winans said backstage of Doolittle.
The show took a serious turn when Green Day performed "A Working Class Hero is Something to Be," a single from "Instant Karma: The Campaign to Save Darfur," a fundraising album for the embattled region.
The finale also had its share of filler, including bits suc as the "Golden Idols," an award saluting the oddest of odd auditions, or the worst. The winners included Margaret Fowler, who proudly accepted her trophy and recited poetry after smooching Seacrest.
Hundreds of "American Idol" fans lined Hollywood Boulevard leading up to the theater before the show.
"I'm obsessed with the show. I auditioned for it this past season. I'm just coming out to show my love," said Sarah Blackmon, 19, who drove more than two hours from San Diego County to attend the finale.
"I don't like picking favorites. They say it's a music competition, so Jordin's going to win," Blackmon said, but added, "I think Blake's really hot."
One of the series' executive producers, Cecile Frot-Coutaz of FremantleMedia North America Inc., said Tuesday she'd be happy with either contestant as the new idol.
"These are some of the most commercial finalists we've had since Carrie Underwood," Frot-Coutaz said. "Either one will make a great winner for the show and the brand. They both have the potential to sell many records."
For their final performances, both contestants sang "This Is My Now," the tune picked by viewers in an online "American Idol" songwriting contest introduced this season, along with two other songs of their choice.
On Tuesday, judges Simon Cowell and Randy Jackson made their choice clear. Diplomatic Paula Abdul kept her counsel as usual, praising both singers. Although the judges didn't have a say in the decision their opinions have the potential to sway voters.
"You were the best singer tonight. You deserve it all, baby!" Jackson told Sparks.
"You just wiped the floor with Blake," added Cowell, who then told Sparks he was wrong for initially thinking she wasn't good enough to win the Fox talent show.
Before the finale, Cowell spoke warmly of Doolittle and what wasn't to be.
"I'm pleased for the two of them," Cowell said of Sparks and Lewis. "They're nice kids. But I would have liked to have seen one of them up against the big singer."
